QEB Hollis Whiteman member Katherine Buckle is part of the legal team appearing in the two day Privy Council hearing of Hernandez and Pitman v State of Trinidad and Tobago, a case which may set an international precedent that could prevent the execution of people on death row who have been diagnosed as "intellectually disabled".
The joint appeals of Lester Pitman and Neil Hernandez concern an appeal against sentence regarding the legality of executing those diagnosed as "intellectually disabled". There is a further appeal against conviction in the matter of Hernandez regarding joint enterprise following the decisions of Supreme Court in Jogee and the Privy Council in Ruddock.
