David Spens QC and Tom Doble were instructed to represent the Managing Director of a group of metal trading companies in appeal proceedings following his conviction for conspiracy to cheat the Revenue after a 6-month trial (he didn’t act for the defendant at trial).
The proceedings concerned a £17.5 million missing-trader VAT fraud. Leave to appeal was granted. The grounds of appeal deal with complex issues concerning the proper scope of a “wheel” conspiracy, and the admissibility of covert post-arrest recordings obtained in breach of RIPA/PACE.
