Sean Larkin QC successfully defended a man accused of manslaughter upon opening his car door into the path of a cyclist who sustained fatal injuries.
The prosecution case was based upon gross negligence manslaughter and unlawful act manslaughter, the unlawful act said to an assault by opening the car door. Following extensive legal research and argument the latter aspect was dismissed at the close of the prosecution case. The jury acquitted of the remaining aspect of the count. Unsurprisingly, the case attracted national publicity.
