Kerry Broome was instructed to defend the mother of three children accused of child cruelty over a number of years.
It was alleged that she regularly beat the children, forced them to sit in stress positions and bit her eldest child. The first trial was aborted after the children had been cross-examined because significant disclosure failings by the Crown came to light. The second trial was again aborted for the same reason and following an application to stay the proceedings as an abuse of process the Crown offered no evidence. An application for wasted costs was made and granted.
