The case was investigated by the police and charges were brought. Dr X was tried in the Crown Court - Selva Ramasamy QC represented Dr X in those proceedings. The jury acquitted Dr X within half an hour. The General Medical Council then commenced an investigation and brought proceedings. After an 8 day hearing in the MPTS, the Tribunal found that none of the allegations were proved. Dr X’s good character was thus preserved.
The case involved analysis of the practice’s computer records to demonstrate movements of staff and patients around the building. Carefully focused requests for disclosure were made, which revealed material highly damaging to the GMC’s case.
