Sean Larkin QC acted for Dr Bawa-Garba at the High Court in response to a GMC appeal.
Following a trial at Nottingham crown Court, Dr Bawa-Garba was convicted of gross negligence manslaughter of a 6-year-old boy and sentenced to a suspended sentence. At a hearing before the MPTS, her registration was suspended. The GMC appealed the decision of the MPTS on the basis that erasure should follow such convictions save in exceptional circumstances.
The central issue is whether failures that were not deliberate or reckless but could be characterised as ‘honest mistakes’ against a background of failures by others should automatically lead to erasure.
The case attracted substantial pre-trial publicity including a 700-signature letter to The Times in support of her case and discussion on Newsnight.
