PC Corker was charged with causing death by dangerous driving following a police pursuit. The defence contended that the suspect had run out into the road ahead of the police vehicle leaving PC Corker little or no time to react.
The Defence team of Mark Aldred leading Eloise Emanual instructed by MJR solicitors made an application to dismiss and then latterly submitted expert reports which were accepted. Ultimately, the Court recognised that this was in fact a “tragic accident”.
Driving cases often raise complex problems of law. Police driving adds a significant layer of complexity which is unfamiliar to many prosecuting agencies. In addition, the cases are considered against a background of political sensitivity.
