Zoe Johnson QC and Paul Raudnitz have today concluded a landmark hearing before Sir Brian Leveson, the President of the Queen's Bench Division, in which the Court approved what is only the second Deferred Prosecution Agreement in England and Wales.
The agreement was reached between the Serious Fraud Office and "XYZ Ltd" following a self-report by XYZ of systematic bribery to secure foreign contracts. During the period June 2004 to June 2012, XYZ obtained some 28 contracts worth a total of £17.24m through the offer of bribes. The total gross profit from these contracts amounted to some £6.5m. Zoe Johnson QC and Paul Raudnitz were instructed by the Serious Fraud Office. The case follows on from the first ever Deferred Prosecution Agreement in this jurisdiction, "SFO v Standard Bank", in which Crispin Aylett QC, also of QEB Hollis Whiteman, appeared also for the SFO.
